Interesting.
So, soon enough, people will be able to copy pretty much anything they like, and say “It was AI generated”, and if standard jurisprudence is applied, it will be up to any complainant to prove otherwise.
This could blow a lot of IP rights right outta the water.
This could have implications far beyond AI-generated art. Anything “created” by AI could end up receiving zero copyright protection. If it is found out that Microslop has massive amounts of AI-generated code in Spyware 11 and other products, does this mean those products are no longer deemed closed source? Would Microslop have to release the code, turning Spyware 11 into open source? Office 365 (or whatever it is now called)? Then there is Apple and Google. I bet Google has massive amounts of AI-generated code inside Android.
This could snowball.
I think people will still be able to hide whatever code they like, and just release binaries. I don’t think that the state has any legit business in telling people to release source code, whether copyrighted or not.
Now, the binaries, however, nothing to stop people from just copying that. SCOTUS just opened a huge can of worms. Now, if people crack Microslop/Apple/Google proprietary software, are they entitled to any legal protections if said software is no longer protected by copyright?
Also, there are other forms of automated design that don’t use AI, like genetically evolved designs.
I think SCOTUS is broken, heck they just said if USPS decides to just throw your mail in the garbage instead of delivering it, you can’t sue them.
Oh, they’ll hide it alright. It’s when they sue someone for copyright violations that they will have to prove they didn’t use AI.
Discovery is going to be a bitch.

Companies have made all sorts of public announcements and such around how they are using AI. That will come back on them (both + and - )
The Supreme Court consists of 4 installed DEI hires, a justice on someone’s payroll, and 4 justices who can be counted on most of the time. The Supreme Court is like the proverbial broken analog clock. It gets things right every so often. It has been broken for some time now.
Oddly enough, Sotomayor was one of the dissenters in the USPS decision. She may know know what a woman is, but she does know that its a bad idea to let the USPS intentionally throw out your mail.
Which is why I don’t get anything that is “critical” sent in the mail. “Critical” arrives via the Internet if possible. Or if it is a physical item, the private sector, such as FedEx or UPS. About the only thing the USPS delivers is junk mail. I go out to the mailbox once a week to clean it out. More or less. Some weeks more. Some weeks less.
On the other hand, any American who gets a notice mailed out from the IRS and doesn’t see it, or recieves a notice for jury duty and ignores it, can conveniently now say that the post office mail route carrier must have tossed it because the “carrier was overworked that day.” Before, if you ignored the IRS or didn’t show up for jury duty, you were deemed automatically guilty and it was up to you to clear your name.
The implications will be very interesting.
As for jury duty, as a rule, they don’t want me. I know racial profiling exists. Old white guys with functioning brain cells are not wanted. They want terminal nonthinking sheep who watch the fake news and believe all of it. Somebody dropped the ball with the Kyle Rittenhouse court case because he ended up with jurors with properly functioning brains who followed common sense and logic, not what the influencers demanded.
Basically corporate copyrights will be enforced and everyone else’s trampled (which is what the models are based on to begin with). I often get bits of nonsense signature and watermark in the AI images I generate for yt thumbnails so it’s clear it’s really just theft and slopping around others’ work.
AI is a powerful tool.
Ignore it at your own peril.
